1. About HikerStats

HikerStats is a web application operated by Vojtěch Kounovský in the Czech Republic. HikerStats allows users to record, organize, and analyse information about hikes and thru-hikes. This may include hiking distances, elevation, moving time, locations, weather, accommodation, food, sleep, physical condition, perceived difficulty, enjoyment, notes, and other information relating to a hike.

These Terms of Service ("Terms") govern your use of HikerStats. By creating an account or using HikerStats, you agree to these Terms. If you do not agree with these Terms, do not use HikerStats.

2. Eligibility

You must be legally capable of entering into a binding agreement to use HikerStats.

3. Your account

Some HikerStats features require an account. You are responsible for:

• providing accurate account information;
• keeping your login credentials confidential;
• maintaining the security of your account;
• notifying us if you believe your account has been accessed without authorization.

4. Your hiking data

You retain ownership of information you submit to HikerStats, including your hiking records, notes, photographs, and other content ("User Data").

You grant HikerStats a limited, non-exclusive right to store, process, reproduce, and display your User Data as necessary to provide, maintain, troubleshoot, and improve the service. We do not obtain ownership of your User Data merely because you use HikerStats.

You are responsible for ensuring that you have the right to submit information that you upload or enter into HikerStats.

5. Support and administrative access

To operate, maintain, troubleshoot, and support HikerStats, the operator may have read-only administrative access to user accounts and hiking data through the HikerStats administration system. This access may be used when reasonably necessary for:

• debugging technical problems;
• investigating errors;
• responding to support requests;
• investigating security or abuse issues;
• maintaining the service.

Administrative access is not intended for routine browsing of users' hiking records. We will use such access only for legitimate operational purposes and will take reasonable measures to limit and protect it.

6. Location information

HikerStats may allow you to record precise geographic information, including starting and ending coordinates and GPS-related information. You should carefully consider whether you want to record precise locations of private residences, campsites, or other sensitive locations.

7. Third-party integrations

HikerStats may support integrations with third-party services, including fitness and activity platforms such as Garmin and Strava. If you connect a third-party service, that service may provide information to HikerStats according to the permissions and authorization you provide.

Your use of third-party services is also subject to their own terms and privacy policies. HikerStats is not responsible for the availability, accuracy, or continued operation of third-party services.

8. Hiking and safety disclaimer

HikerStats is a logging and analytics application. It is not:

• a navigation service;
• an emergency service;
• a rescue service;
• a medical service;
• a weather warning service;
• a route safety service;
• a substitute for professional advice.

Information displayed by HikerStats may be incomplete or inaccurate. You must not rely on HikerStats as your sole source of information for decisions involving personal safety, navigation, weather, route conditions, medical conditions, or emergencies. You are responsible for your own safety while hiking.

9. Service availability

We aim to keep HikerStats available and functioning, but we do not guarantee uninterrupted or error-free operation. Features may change, be discontinued, or be replaced.

10. Data loss

HikerStats is not intended to be your sole backup of important hiking information. You should maintain your own copies of information that you consider important. We are not responsible for loss of User Data to the extent permitted by applicable law.

11. Acceptable use

You must not use HikerStats to:

• violate applicable laws;
• impersonate another person;
• gain unauthorized access to another user's account;
• interfere with the operation of HikerStats;
• attempt to access systems or data you are not authorized to access;
• upload malicious software;
• abuse, harass, or threaten other users.

12. Intellectual property

The HikerStats software, design, branding, interface, logos, text, and other materials provided by HikerStats are owned by or licensed to HikerStats and are protected by applicable intellectual property laws. These Terms do not grant you ownership of HikerStats or its underlying technology.

13. Feedback

If you provide suggestions, ideas, or feedback about HikerStats, you agree that we may use that feedback to improve the service without owing you compensation.

14. Suspension and termination

We may suspend or terminate access where reasonably necessary to:

• protect the service;
• investigate abuse or security incidents;
• comply with legal obligations;
• address violations of these Terms.

You may stop using HikerStats at any time. You may request deletion of your account and associated data.

15. Disclaimer of warranties

To the maximum extent permitted by applicable law, HikerStats is provided on an "as is" and "as available" basis. We do not guarantee that:

• HikerStats will always be available;
• information will always be accurate;
• calculations will always be error-free;
• data will never be lost;
• integrations will always function;
• the service will meet every particular requirement.

Nothing in these Terms excludes rights or protections that cannot legally be excluded.

16. Limitation of liability

To the maximum extent permitted by applicable law, HikerStats and its operator will not be liable for indirect, incidental, consequential, special, or punitive damages arising from your use of the service. Nothing in these Terms limits liability that cannot legally be limited or excluded.

17. Changes to these Terms

We may update these Terms from time to time. If changes are material, we will take reasonable steps to notify users.

18. Governing law

These Terms are governed by the laws of the Czech Republic, subject to any mandatory consumer protection or other applicable laws that provide otherwise.
